    In a Joint Mortgage with partner who has declared bankruptcy

    I am in Arizona and have a joint mortgage with a partner who has recently declared bankruptcy. The mortgage is not included in the bankruptcy; I have never been late on payments and intend to continue making payments in full. Does my partner's bankruptcy affect me/my credit/the mortgage in anyway?

    The mortgage MUST be included in the BK, as it includes every debt that is owed at the time of filing. The mortgage can not and was not excluded.

    That being said, as long as the house payment is made on time each month you should have no problems.

    Your partner filed, you did not. So lets say for whatever reason you both walk away from the house. Your partner does not owe a cent, and you will owe the remaining deficiency balance after the house is foreclosed and sold. The reason for this is that your partner is longer legally liable to pay on the house.
