I just talked to the 5th BK attorney who finally answered the question about residency for my husband & me and where we could file. I'm so frustrated with how none of this BK stuff makes any sense. I just need some thoughts.
Briefly, I moved to SC to be closer to my aging parents. My husband stayed in GA to continue with his job and look for a job in SC. We moved all of our belongings here. We filed our income taxes jointly here in SC. Everything we own is joint which is in SC. For the most part he just works in GA.
The attorney informed me that because he resides in GA (the majority of the 180 days) he will have to file a petition in GA. And, because I reside here most of the time I will have to file in SC. So, that means double the filing fees. And, supposedly, everything will be split 50%. How can you split a house 50%? How can you split a joint bank account 50%? How can you split a credit card debt 50%? This makes no sense.
And, I don't have a job now - business closed. So, I'll probably be qualified for CH 7. But my husband has a job. Will he have to go CH 13 with the other 50%?
