I met with an attorney and I currently make too much to qualify for a Chapter 7. But if I file a Chapter 13, I'd basically be working a high stress high pay job to pay off debts. I have fibromyalgia and my doctor has been recommending that I find a less stressful job. I have always resisted because I was paying off debt. If I can erase the debt, then I could take a less stressful job. I haven't filed yet but I'm debating quitting and finding a less stressful job that meets the income requirements for a Chapter 7. Will the bankruptcy court force me into a Chapter 13 because I could potentially make more money? I have a call into my attorney but they haven't returned it yet. Thank you for your advice.

I asked a similar question awhile back. If you can wait the six month lookback to file so that your income would be the same, I don't think they would question it.
