Been thinking about when I get an apartment and wanted to know if this was a potential issue. What happens to the security deposit if the Landlord files for bankruptcy? Do I get it back or am I out that money?

Good question - we're filing - but we're making sure our tenant's lease isn't affected (timing it right) and she will definitely get her deposit back. But legally - I don't know.
Brings up a good point for us too since we'll be renting in the future as well. I plan on paying three months rent when we move in plus the deposit - so hoping our future landlords are just as considerate.04/01/10 - Hit rock bottom and knew we were going to have to file for bankruptcy and surrender our home.
