    I have a pretty good feeling what's going to happen after the bk..... I'm going to get a rental bill in the mail for the water heater - just as I did when I first moved in. I'll probably be stuck with the same situation again unless I have something in writing from them trying to get me to pay for the heater that I can go bk on. I just have that feeling.

        lol....No I'm keeping this one. Remember this one gives me eternal hot water that the girls in the house like. I just have to figure out how to get them to bill me for the heater before I go bk.

        I don't understand. If I'm two days late on a cc payment, I get endless calls until I answer. I haven't paid this bill for 5 months and have to call them and insist they turn me over to collections.

          Once you list them, Jim, they are not allowed to bill you. If they violate the stay or the discharge order, sic your attorney on them.

            This makes me think of the stories I've read where people didn't reaffirm things. One was a mortgage, another a car and the lenders didn't come after either. Even tho they said they would, I wonder if they really will come to remove the water heater. As Staci pointed out, $800 is the value of a NEW water heater. How much is it really worth now??!! Are you keeping your house where they could put a Mechanic's Lien on the title if you don't give up the water heater??

              if its included in the bk then a lien cant be placed.

              list it, see what happens, you will know about what to do with it after the bk is done. this is because if you list it then some action on their part has to take place to secure it with a motion of some sorts.

                I can't see that they want it. The OP stated he gave them a chance to get the heater, but they wouldn't until the account was current. What kind of nonsense is that??? If someone missed 5 months worth of car payments surely the finance company wouldn't wait to repo the vehicle until the account was current (Chances are they'd have picked it up after 2 or 3 months.).

                Out of curiosity how old is the heater?

                    The service tag on the side shows it had a coil replaced in 1998, which means it had to be old enough to have its first breakdown in 1998.

                        make sure you clean it out. the sediments lay on the bottom over time and take up all the space in it, making it worthless.

                          I checked it out awhile back. This unit is a basic commercial grade as used in commercial kitchens, hotels, etc. It's 3x the volume of water of a typical residential unit - three women can shower in a row without running out of hot water. It's truly amazing. It has a stainless steel tank, which means it will never go bad. All that is left is a couple coils, thermostat, and wires. This thing can last as long as I want it to.

                          If it wasn't so damn good, I would of made them take it out when I bought the home.

                            Jim-keep your love fest in private. Concentrate on this: its old. Appliances naturally wear out. It has no real value to anyone out in the real world.
