    Martial Arts contracts?

    I have emailed and left messages for my lawyer but havent heard anything back yet. I was wondering if anyone had dealt with including a martial arts contract in their filing. We were going to try to keep it and budget the funds out of other areas, but after finally getting a real budget put together accounting for everything there simply isnt the money available to keep paying $170/month for the 2 kids. One has ADHD and the Dr recommended TaeKwonDo, and to be honest the improvement has been tremendous (in both kids), but the lawyer said the trustee wouldnt likely buy into it, and not counting it we only have a DMI of $255, so if it got included in the plan we would not have a viable payout, he seems to think anything less than $200 doesnt fly with our trustee and I believe him. So, my question is how does this get added into the matrix? Does it count as a secured creditor? Unsecured? The finance company is pretty nasty. We are late and now they are already calling and threatening us, and adding fees every day we dont pay. We were trying real hard to make it work but they wont work with us at all, so I give up.

    We were also using the TaeKwonDo for after school and summer daycare. By having them enrolled in school we were getting a good rate on the daycare part. We havent talked to the owner yet, but we did pull them out of daycare for now as well. Since this is a 2nd party collector I think the school already got paid on the contract in full, but I am not sure. I was waiting to hear back from the lawyer before talking to the owner. We cant keep paying on this but if she was already paid I wonder if they can at least continue until the term expires? Or worst case if the kids can still go there if not for the training but at least for daycare. It really was the most affordable option, just not with the extra $170/mo added on.

    Although it really doesnt matter I am curious how the amount of a contract for services gets included in a BK13. This would be applicable for others I suppose if its the same for rental storage places, cell phones, ect.

      If the Tae Kwon Do is a licensed daycare facility as well, you should be able to count it as your childcare as long as it is for work only. How much is the childcare with the martial arts? How much is it without it? If the difference isn't that significant, you may be able to include that. Especially for the one child where the doctor recommended it. Also, if you talk to the head instructor, they just may work something out for you. My kids and I have been taking Tae Kwon Do for years. I haven't paid tuition in over a year. I clean the Dojo instead, plus my ex pays his portion of the kids' fee, so it works out.

      Your instructor may be willing to give you a break (as long as you don't advertise to other parents about it) if you talk to him/her.
