Crazy question...Should I file bankruptcy if my debts are almost a year old?
I stopped paying my bills last summer. All bills including the house, auto loans, CC, and student loans (wife's) and a small amount of revolving, like the house alarm contract for the house I do no longer own.
First the house payment stopped about a year and a half ago. The house has foreclosed, moved on without the 200k of negative equity, and the debt has been forgiven. Was the primary household, and I never refi'd, so it was discharged.
The bills got super tight, and with the house going, the CC and etc stopped payment about 6mo after the house stopped payment. Again, about a year ago last summer.
Bills got tight because the job lost its revenue (commission sales). Lost the job due to that fact, so now I am on unemployment.
Because I have an almost debt free living (since I am no longer paying bills) I am not entirely sure if I will qualify for a Chapter 7. I have not talked to a BK lawyer yet.
What happens if I continue to not answer my phone, and make no payments? Will everything "disappear" after 7yrs to a clean slate?
I have already stopped receiving the house calls, auto loan calls, and some of the credit cards. I believe they discharged the loans as well. Only one or two are still calling and that's it.
Will I or should I take out small prepaid CC to re-establish credit? I have one or two accounts that were 0'd out prior to the BK, so I will leave those be so that they do not close out when I try to ask for credit.
Just not sure if the BK and the $1500-$2000+ will be worth it on my credit, esp if I will not possibly qualify for ch7.

Are discharged debts still considered in your BK as monthy expenses?
Should I just wait for 7yrs for the derogs to discharge and disappear?
Or is it better to file BK even though its no longer a major concern?
And does it benefit to re-establish credit via prepaid credit cards, or should I just leave the credit be for a few years?
