Thank you--this site is better then a professional credit counselor!!!

Have already found more good advice here then from a professional credit counselor!!!!

We asked the professional credit counselor if she could refer us to a lawyer and she is like I can't do that. Found her from the BBB website. The gal who set up the appointment stated the counselor would be knowlegable about Colorado law. But the counselor couldn't answer any of our major questions with anything other then seek legal counsel.

Going to court to watch an attorney in action seems like common since; but, I hadn't even thougt of it.

keep in mind you dont see much of anything the attorney does if you watch him in court. because they dont really do much at all in court. its a fast 5 minute or less interaction with people and they are done. but you can gleem some ideas about who the court and its people likes more then others.

your better bet with your time would to be actually go and get free appt from as many attorneys as you can get. each one you will know more about your case and what you want from your attorney.

going to the 341 meetings will help you see how it goes but again the attorneys dont do much of anything there.
Im not an attorney or a trustee. You cant trust me either though!

Giving legal advice-when you don't have permission to practice law-is a big nono so the counselor was doing what she was supposed to. Keep in mind that we are not legal professionals here-but there is alot of 'been there, survived that' type experience! It doesn't replace legal advice, but it may help you to know what to ask when you do speak with an attorney, and what to expect along the way!
Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

Well the gal who set up the appointment mislead us.

        We thought being a non profit . . . .

One would think that a bankruptsy counselor would know some generalities.

Such as is there a limit to how much a house you want to keep is worth?

My wife has had this house for 7 years. She has lost jobs due to no falt of her own. And my employer was unequivically unethical in getting rid of me due to injury and illnesses. But sadly I can't prove that is why they got rid of me.

We have a rental which she use to love but we are realistic in knowing we will lose that. It totally breaks my heart that she will lose her rental because of unethical employers.

We just want to keep our house. I have borrowed against my 401K.

I'd disagree with that BKfiler..The thing you "Look" for, is how they are prepared..Remember the way Staci and some others have had their lives effed up totally?

If the lawyer is competent and good, they'll sail through each of their cases with ease....

Look NOT for style, but how well they have their clients informed and covered...

and dont bother asking their clients at the 341 meeting if they like their attorney. we were all 'deer caught in headlights' plagued at that momemnt and thought of our attorney as our saviour lol.

my bottom line was that i needed an attorney that was willing to deal with all my questions and was willing to fight for me if there were objections. not pass me off cuz he didnt do that type of work. getting an attorney like that will be beneficial becuase the creditors know what attorney fights and dont fight. they keep a database im told. so i figured id better get one that fights.

plus i needed one that would be able to look at me through my hours of questions.

Yea, I agree that going to the meetings are a good idea, and give the same advice, look at the preparedness of the attorneys and their clients.

My attorney was on the ball had me prepared, I looked like I went through bankruptcy prep school or something...

There were other people that totally unprepared, looked uneducated about the whole process, and just showed up and hoped everything came together on its own... These were the people that the trustee interogated the most...

1st of all this site is free, reasonably honest and well-meaning (all ya'll know what/who I mean). 2nd, most of us are there or going there. 3rd - knowledge and experience are power, the lawyers many of them are good (mine was great) but first of all they don't have a stake in this except for their pay and generally that has been paid, they can only go by the information that you gave them. This forum provides you important information and advice that you or our attorney hasn't thought of, also tells you that we are real people who have gone thru this and are willing to pass along are experiences and information that may be helpful in "your" situation.
THE BIG + is that we can relate to your situtation.
I'll be watching, you may never know when or how, but I'll be there. I am there now....
