    Relief from stay

    I had posted a few days ago about the rental properties I have and my situation with Indy Mac/One West the question I have is they get the relief from stay at the hearing next month, I am one payment behind with them..so if I am all current by the time they get the relief from stay what happens? do they still try to foreclose or just send me a bill each month??

    your only 1 month behind? a foreclosure aint gonna happen for several months, but they will seek a lift so they can at least communicate with you to resolve the delinquency.

      If you are current BEFORE the relief from stay, you can attend the relief from Stay hearing and present evidence that you are current.

        Did you re-affirm the mtgs?

        Sounds like you didn't and being delinquent besides, makes you very vulnerable.
        Like dangling raw meat into the mouth of a lion... what happens next? Chomp, chomp.

          No I wasn't going to re affirm, they are rental properties. The rents cover the mortgages so I was thinking I was going to keep them, I will have them current by the hearing. Do I have to attend the hearing? or does my attorney go?

            Your attorney would go. He can plead that you are current then.
