    crashed

    i was trying to figure out what was going to happen to my harley davidson if i filed bk... a kind lady helped me out, by running a stop sign and crashing me, with the wife on the back..

    we are lucky and after an ambulance ride to the hospital, we are back home..

    the woman who hit us was charged, but a call to her insurance company, reveals that she probably doesnt have insurance... geico wont tell us one way or the other, due to privacy laws..

    i had comprehensive coverage on the bike, but not uninsured motorist...

    im thinking about calling a lawyer, but what good will it do?

    None if you don't have a stack of hospital bills to show.

    I was hit by an uninsured motorist. My insurance covered everything, including damages for pain and suffering, but I did not have uninsured. My comprehensive policy covered it.

    Seems to me that if you have comprehensive then uninsured can be a waste of money. I'm sure there's probably an insurance agent that will pop in and say otherwise, but my experience tells me otherwise.

      the problem, is that in florida, your health insurance covers you in a motorcycle crash, unlike a car...

      so. that means that i will have a bunch of deductables from the medical part to pay out of my pocket.. i have blue cross, blue shield....

      my insurance company is paying for the bike repair, minus the deductable...

        Your medical insurance company is probably going to sue her to seek reimbursement if she was at fault for the accident. Chances are the bike insurance company will also. Both of these companies will also seek getting your deductible money back.

        If they decide not to pursue it however you can always sue yourself for all your out of pocket expenses.

        Of course, usually someone without car insurance has little to take. If you get a judgement chances are the person that hit you will be posting here a month later.

          She really should lose her driver's license if it turns out she doesn't have car insurance. You may have to follow up on her case, but she shouldn't be allowed to make this mistake again.

            First, I do not work for an insurance company:

            I live in Ga, and in late 2007 I dropped our UM coverage to save a few bucks.

            In April of 08, my daughter (15) was on her way home from a Church concert event with her best friend and 2 others, with the friends mom driving. Make a long story short, they were hit head on by a drunk driver. My daughter suffered a head injury, and two years later when she finally received her settlement from drunk guys ins., out of 50k, my daughter will end up with around 20k after they lawyers, etc., have all take their share.

            I found out later that if we had the UM coverage (doesn't matter whose car she was in) she could have gotten money from that too. The mom who was driving received money from her own UM coverage, since the drunk guys policy only covered 100k total (2x 50k) and I assume one of the other kids parents got something from the drunk guys ins.

            You may be thinking, 20k is a lot of money, but she will need plastic surgery in the future, which medicaid won't cover (and as of July, she won't have health ins. at all because she will be 18..the state doesn't cover them the minute they turn 18), and she is barely graduating this year with a 2.0 and will struggle to go to college, etc. Because of some a-----e's decision to drink and drive. Lasting migraines, memory loss, and a lovely dent in her forehead....

            I promptly added back on our um coverage after this, it only added up to around $100.00 or so a year extra in premiums.

            Wish I would have known. Just my 2c...

            Oh, and this is why we will be filing bk. Because my husband's employer fired him after Aetna racked up 80k in medical bills..too much of a risk for their company.

              Let me say how sorry I am to hear about your daughter and wish you all the best.

              I'm no insurance agent either but have discussed my situation with a number of personal friends that are. I don't understand how you carrying Uninsured Motorist would have helped. The vehicle that hit your daughter was insured, and I assume that the driver of the car your daughter was in was insured as well. In this situation the insurance of the responsible party would cover up to their limits, then the insurance of the vehicle she was in should take over, then your personal insurance. That's how it worked in my case, but I guess each state has a different process.

              So maybe the UM would pick up the slack if both of those policies were exhausted. Sounds like the drunk driver was underinsured, and maybe the driver of the car your daughter was in.

              If Aetna is picking up the tab for medical they will go after the responsible party. Unfortunately it sounds like you've settled the case, but if not I'd certainly advise speaking with an attorney about the damages your daughter has suffered that have not been reimbursed.

                UM is UNinsured and UNDERinsured. In this case the dastardly drunk driver was UNDERinsured. (not to mention that he should also be shot, IMO). What a shame.

I believe the way it worked was that the Mom received compensation from HER UM coverage, the daughter received compensation from the Moms policy limits, and the one other kid received one half of the drunk's 100k limit, and my daughter received the other half(lees the lawyers take). I guess part of the problem here was that there were 4 people with injuries and only so much to go around. My daughter's were way beyond the scope of the 50k and by the time we realized that and our lawyer checked on the Mom's UM coverage, she had already taken the limit on her policy, so in essence, we could have claimed against our own UM limits, had I kept the coverage.

                  I just really wanted to chime in on the original poster here, because I also thought that UM was unnecessary, but in our particular case it could have helped.

                    Hey, Floridian, I hope you are doing ok, and you should call a lawyer, but if you are thinking of it, I can tell you which one NOT to call in Florida. We hired one of the big guys there, and the incompetence was unbelievable. IM me if you want, I do not want to post his name here on the board. Good luck!
