If a credit card sues and gets a judgement against you before filing Ch7 can it still be included in the Ch7 filing?

The reason I ask is that I see a lot of posts that people are served summons and say they need to hurry and file BK before a judgement is given.

Yes, you can include it in your bankruptcy filing. The reason most people want to avoid a judgement prior to filing is twofold: It keeps a judgement off your public record, and it keeps the creditors hands out of your bank accounts and paycheck (garnishments, etc) before you file for bk.

There would be no point in filing for bankruptcy if judgments were not included. All creditors would have to do is obtain the judgment in short order and the debtor would be ruined for life. Bankruptcy is probably the reason why more creditors do not file lawsuits immediately.

I am a Newbie here and had never imagined that I would need to file for bankruptcy. However, unemployment will do that to a person that has excellent credit prior to being laid off

Only problem is their information is incomplete. Judgments do survive BK discharge until vacated. Please read this thread:
