    Child tax credit

    When the trustee takes your tax refund check, does he have to give you back the portion that is the child tax credit and earned income credit?
    Does one mail the check to him when it comes or does he get it from the IRS directly? Do you sign the check and then mail it?(that sounds like it would be dangerous if it were lost in the mail.

    Generally, the portion of your refund that is related to child tax credit, (and earned income credit for that matter) is exempt, but this may vary by state, so check with a local attorney.

    The IRS will sometimes pay the refund separately, for instance, say $1,000 is EIC and $1,500 is regular tax refund. You'll get two checks (or direct deposits) from the IRS. Not sure when and why they do this, but it does happen.

    In regards to how the trustee will get the money, that varies as well. Some will notify the IRS that they want it sent directly to them, others tell you to get a check, not direct deposit, and then turn that over the them, still others don't care, just want to see your return to decide if and how much they want and can take.
