    Ok - as we still consider whether or not we are going to file ch 13, we have all these questions and possibilities going through our heads to avoid a bankruptcy.

    We are still waiting for response from BOA for a loan modification, we are almost 2 months late on our payment. So, if we were to make our regular payment Feb 1st, would that stall a potential foreclosure? If we were able to make our regular payment, every other month.....if they don't modify our loan...i am just curious how that stalls a foreclosure (or does it?)

    It's a big "it depends". If you are late, the lender can foreclose. I got a foreclosure summons from a bank when I was 25 days late on a business property.

    They may see the payment and decide to wait to see if you are going to keep paying, or they may not. My guess, if they see you only paying every other month they are going to proceed.
