    Question WWYD about when to file?

    We are originally planning on filing in February. The only problem is we are living with our in-laws right now and we contribute 500$ to them every month and we buy all of our groceries as if we lived on our own. When I figure out how much we have left over every month we are in the positive about 400 because we are living here. Those are not normal circumstances and no one can expect a family of five to be sharing one bedroom forever. Should I wait until we get a place of our own, which may not be until the kids get out of school? Or should we go ahead and file like planned? Does the trustee take into consideration that our living situation is not the norm, and it is only temporary? I don't mind waiting to file until the kids are out of school but I am just worried about being sued by then. We just hit the 90 day mark for being late on all of our CC's. I don't know if I have WAY over thought this and now I have myself confused and scared, or if I am thinking correctly on this. Last thing I want is to be forced into a 13. Right now we are a 7 no asset. We live in Dupage county Illinois if that matters.

    If you're a Chapter 7, do all in your power to stay that way.
    Ask your lawyers how anticipated future expenses are handled in your district.
    You likely have many more months before anybody sues and if they do, any judgment is discharged in the bk.

      Can you find a place to live on your own that costs less than $900 for the rent and utilities?
      Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

        Everything I am finding right now is for about 1100, and that isn't including utilities. Once we claim bankruptcy we will have even more left over because we are pretty sure we are including the car in bankruptcy. That is another 554 right there that we wouldn't be paying on the car anymore. The 400 we have left over every month right now, is our old credit card minimum payments.
