    Just Divorced- Can I file?

    My friend just went through a nasty divorce, she got non of the property but it still has her name attached to it and its about 300k worth of debt. This is all in her ex husbands possession. She lives in California, makes less than 2500 a month which half is alimony- but she can't even get a car loan because of all the debt attached to her name. Can she file for bankruptcy? IN the divorce it said she is to be "held harmless" whatever that means. The ex husband is supposed to refi and get her name off but there is no time limit so it could be 10 years down the road.. Any ideas on what she can do? thanks guys!

    Being that she is "held harmless" in the divorce decree likely means that he is responsible for the debts they have. The problem with this is it does not release her from liability with the creditors. In short she will still owe the money if he doesn't pay.

    Based on the brief description of her finances she is probably eligible for a Chapter 7 BK.
