I broke my back in a wreck that i was not in fault at and there is a big lawsuit involved in the 100k range. We have to bankrupt on possibly 35k does this effect money that I am not guarenteed to get in this lawsuit?

Yes, you will have to disclose there is a pending lawsuit and disposition of it. The Trustee may actually want to take over the case if you are the one claiming damages.
