    will I have to move?

    I don't own a home and we are renting a house. I've read all kinds of information on people who are late on their rent and have been evicted, etc. I can't seem to find anything on people who have kept up with their rent, what happens to them? Will I have to terminate my lease and find a new place to live because I filed for bankruptcy?

    Short answer - no, you won't have to move. As long as you're current and making payments your landlord won't care. However, they may choose not to renew with you when your lease it up.

    I do not see this occurring. With the number of vacant apartments in my area, as long as you've had a good history, they'll offer to renew.

    (I filed recently and just had notice that my lease is coming due again. The new lease agreement was included with my notice.)

      When you say that you had to put the notice in your papers, do you have to list your rental lease on the forms when you file?

      Sorry for the addition question...I'm a newbie to all this info.

        No problem with the questions. Be aware, I'm fairly new here myself, so this is all from personal experience.

        I filed a Chapter 13 and my roommate is currently in the process of filing a 7. We are in MN and for both of us we needed to include our lease in the filing paperwork. As far as I could see it was only to indicate how much rent we were paying monthly.

          In my case I did have to list my security deposit for my rental, as well as deposits for gas and electric, but I did not include my landlord in my mailing matrix. So unless they routinely check my credit (highly unlikely since I'm current) or court records they don't have any idea.

          Bottom line is that no intelligent landlord will evict you for filing as long as you are current. If you have other issues with your landlord they might use it as an excuse, but if you're a "good" tenant you have nothing to worry about.

            We have no problems with our landlord. We pay our rent on time every month.

              I am a renter as well. I informed my landlord at the time of my BK and he said it was fine as long as I kept my rent payments current. I did not even list him on my matrix but had to list my security deposit. It all depends on the landlord, but I think in times like this, open communication with the landlords and keeping rent payments as current as possible, chances are landlords will be receptive about renewing leases.

                In my recent filing I did not need to disclose my landlord as a creditor.

                I only needed to include the rent for the monthly expenses and the security deposit as an asset.
