    Question co-signer on morgtage

    I have a consultation with a lawyer on Tuesday and DH and I are trying to come up with all the questions that we have for him (he can't get out of work to go, so I am going solo). During this process we just remembered that his father co-signed the house when we bought it. We were just moving to a different town and had just switched jobs so there wasn't that payment history to he signed with us to help the process finish going through smoothly (we were almost at the end of purchasing it when DH switched jobs - not the best move, but couldn't pass up a job offer here vrs not having a job at all)
    With my father in law's name on the house too, with us filing for bankruptcy, is this going to affect him too? We have been late on the house payment, but never more than 29 days and are planning on not paying our credit cards anymore so that we can get back on track with paying the house (and car) on time. We are planning on keeping them both (and will easily be able to afford them if we could get rid of the credit card and medical debt we have.

    Anyone have any experience or knowledge on this? We don't want the bk to show up in his name or hurt him in anyway!! Thanks for any info!

    There's a place where you have to list his name and yes he will be notified. However if you reaffirm the house debt it won't affect him long term I don't think.

    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      My ex was a co-signer on my mortgage when he filed BK. I was current on the house and his filing had absolutely no impact on me as far as the mortgage was concerned. After his BK the mortgage continued to be reported as "pays as agreed" on both out credit reports. Your filing should not affect your co-signer/dad as long as you stay current, or even 29 days late.
