    Needing some input please

    Today in the mail my husband received a large envelope a copy of every single statement American Express has ever sent him regarding his account with them. No letter and nothing even saying it was from American Express. We had planned to file bankruptcy in late December but have decided it would be better to wait until January. We have yet to retain an attorney. Does this sound (the package that arrived by mail) familiar to any of you? Please if you could give me some input I would really appreciate it!

    Did either of you send a DV letter to AMEX or a creditor? This sounds like the response to a DV.

      I don't think that amex would send that unsolicited. Did you fight a lawsuit or request debt validation? Amex is notorious for keeping VERY good records, and if you DV them they would send you everything. (just like they did).

        Yes, I sure did send them a dv letter. Thank you for responding. I guess that would make sense. Now I'm wondering how long I have until they go forward. I'm hoping to file by the end of next month. Do you think I can hold them off until I file?

          Even if they filed a lawsuit right away, you would have 20-30 days to respond to the summons with a reply. I think you will be able to file before they get a judgment, if that is what you are trying to "beat the clock" on time wise.
