    Question Bankruptcy and LLC

    My girlfriend needs to file Bankruptcy, the thing is she formed a Delaware LLC about 6 months ago, We obtained a FEIN and a state tax ID. The business never materialized and the business has NO assets. It's just a name on a Delaware LLC paper and a PO Box.

    How is this going to affect her filing bankruptcy. Technically she owns a LLC, But it is name only and the business is worth exactly $0.

    What should she do? It's already frustrating that an attorney wants $1000 to file (and we didn't mention the LLC yet) How the heck does someone needing bankruptcy protection come up with a grand? ugg

    If all is as you say, it shouldn't be any problem. If the business has any assets, they are up for grab. Any accounts receivables will also become an asset for the trustee. Otherwise, there's nothing to sell and will probably be abandoned.

      you have to list it on the petition and give its value, receiveables balance like frogger said. Its listed on your assets
