    BK Planning and reducing income

First, is the 6 month income period looked at up to the day you file? So if my parents file in say 3 months the income looked at would be the past 3 and the next 3 months.

Second, my Dad is 65 and has had two heart attacks and lives out of a truck for 5 days a week 50 weeks a year. At his work he has the option to drop his work schedule down to 3 or even 2 weeks a year. He does not take SS yet, but will when he turns 66 in Jan of 2011. So, while he makes about $1500/mo making a Ch 7 difficult to qualify for even in Calif, if he voluntarily dropped a week a month for 6 months, then qualification would be automatic as they would be below the Calif Median income by almost a grand a month?

They would have no other income at that time.

IT's the 6 months of income prior to filing that is considered. Income after filing is not included in the means test.
Your father would not be the first to take steps to reduce their income in order to qualify for a Chapter 7.
Have they seen an attorney? The income is just part 1. They still need to fill out sachedules I and J to determine any disposable income that could fund a chapter 13. We've had many filers here who were over the median but, had enough expenses that they qualified for a Chapter 7.

$1,500 per month income is WELL BELOW the California median income.
Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

Sorry, I totally misquoted my Dad's income. He makes about $1500/mo over the Calif Median amount, not just $1500/mo.

P.S. We are meeting with an attorney on Monday. Will try to meet with 1-2 more also.
