    I am being sued by CITI

    I was layed off several months ago an d I am unable to pay my CCs. I just received my 1st summons from CITI card. My question is can I file BK against their judgment after the lawsuit? I have no job. My only income is Unemployment for as long as it lasts. I do not want them to get a judgment against me then garnish my wages when I get a job.

    Since you are unemployed (sorry to hear) I would let them sue and you should just clean out the bank accounts and wait till you get a job to file chapter 7.

    If you happen to need expensive medical care with no benefits and no income you will lose your ability to file chapter 7 if you file now.

    Since there is nothing to garnish now you might be better off waiting and filing once you are hired.

      I have medical benefits through Veterans Administration thank God.

      Should I attend the lawsuit hearing and or let them win by default? Being unemployed I do have time to appear at the hearing. Unfortunately.

        If you have medical coverage then filing sooner would be ok.

        I thought you probably didn't have anything which is why I said to hold off.

          Delaying tactics

          You can file an answer with the court - I cannot affirm or deny based on info provided. That will give you time to find a BK lawyer. Don't let it go to default judgment
