    What's the likelyhood this creditor would object/show up to 341?

    I have one card with the majority of my credit card debt on it from Citibank. It orginally had a limit of 10,000.00 in 2006 that eventually over time went up to 30,300.00.

    Through balance transfers, using the card for expenses for living/work expenses, etc. ended up maxing out the card.

    At the time I opened the card my future seemed bright and money was constantly coming in. I didn't really take into account things like lull in work, or an economic crash.
    My formula was basically like "my day rate is on average 200-250.00 a day and I work at least 3 days a week, not counting all the extra work I get so my income must be about this"

    Needless to say I have never come close to claiming what I made yet.. I always made my payments on time and every time I could, paid more than the minimum.

    Some things may look like luxury purchases because I did rent clothing for shoots and did buy and return merchandise on the card. Which led me to believe I could afford some things for myself too!

    I have not used this card since Feb 2009. With the whole economic crash scare they upped my interest rate and increased the minimum payments by 400.00. I opt-ed out of the new terms thinking I could still pay it but stopped paying at the end of March.

    My lawyer requested the transaction history on the card going back three years but Citibank never responded to his request. He doesn't seemed worried about this now. Is this any indication that they may not care/may not object/show up?

    Large banks like Citibank rarely show up to 341 meetings. It's usually CU's or angry family members, etc that show up.

    What were your last purchases on the card? Would any of them be considered "luxuries"?

      At this point I have no idea what my last purchases were.. Possibly my cellphone bill (not a luxury) and some small purchases when I went home in March (all under 100.00 each)...

      In Feb. I did a shoot and I purchases probably 5000.00 worth of clothes across several cards but returned everything except a couple pairs of underwear and socks..

      The only things I think I've ever bought that I kept over 750.00 might have been two plane tickets in 2007. Anything I did buy that I couldn't afford I think I could at the time because I was so delusional and bad about managing my money.

      I have had bought purchases though for jobs, over 750.00 but returned some or most of the items..

      Someone said that its on the credit card company to verify the information on credit applications and the fact is I made timely payments on the card from the time it was opened up until I considered filing for bankruptcy and that pretty much proves I didn't knowingly try to de-fraud anyone. I don't know if this is true though.

      I do my budget tomorrow and sign all the paperwork and I'm freaking out about citi sending an attorney to get me.

        30K is about average in that I've seen. B2S is correct in that the bigger banks don't send lawyers to argue with a Trustee or you at a 341. If anything they would sue you in an Adversary Procedure, but this is very rare.

        If you have not used this card for this long, I would go without concern. Understand, these banks now are getting flooded with people in worse trouble than you. Go file and get it over with. 'Hub

            In all at the time I stopped paying I had about 45k in total debts but they're all small balances (except for one amex at 9,000.00) but said they are all easily discharged..

            I'm just very nervous about everything too because of my freelance income too. My income statement looks good but vs my budget I'm almost at a negative with the tax payments and legal fees I have paid... But most of this money for these things have come from payments over six months ago.. so the math is a little funny..

              Still nervous because there was a while where I was like "I can afford this, and this and this!" but not anytime recently.. I haven't relied on credit at all since feb. 2009.

              I'm just worried about this card, the math in my financial statement being a little weird (March and April were big months for me and they are not on my statement, but a lot of my taxes and legal fees came from payments in this period)... and the house I was on title to with my mom.. I was 20 and manipulated by her.
