I am about to start the paperwork on filing a pro se Chapter 7. (Hopefully not forced into a 13) It would be in the Southern district Court of Alabama.
Here is my situation:
As of Nov 1. Median income single family in AL $38,415/yr.
i am at $28,285 right now, will go down by Dec. when I plan to file.
Almost 10,000 below median.
i have: --$33,000 in cc debt--
--$4,200 in tuition owed to Local UNIV.
--$108,500 in student loans to Sallie Mae.
The loans come out of deferment in Dec. and the mo. bill is $760.
Thy have done away with the 20% deferment, where you automatically
qualify for economic hardship if your payment is more than 20% of your net wages. They killed it July 1 09.
With the means test on legalconsumer.com I have about $49 DMI.
With schedule J I have somewhere around $500 without including the loan payments. If I include them I have negative DMI. I know it varies from district to district but i feel being forced into a chapter 13 with interest and fees would hurt me more with the amount of SL debt, even if it did pay back some to unsecured creditors. Any advice, knowledge would be greatly appreciated.
i may have to go to an attorney on this one, though I would rather file myself to save the $$$.
