So most of you seem to be familiar with my story.
We met with a great attorney today with over 25 yrs exp practicing BK law. He helped us figure out the best time for us to file (next april 1st), he advised me to give up my job and go to school full time (confirming what 3 other attorneys have advised) and believes that we can be a chapter 7 with a few changes to our lifestyle.
Today is the first time I have felt semi optimistic in months.
- he said that the trustee's in our area will see us as a no assest case and take into consideration how our business debt is 70% of our debt, but we might have to explain a few other things in detail pertaining to our praticular case. Since we most definitly do not qualiy for ch 13, he said that it was highly unlikly that we would be forced into a chapter 11 based on our circumstances ( he does ch 11 as well) ...
1 question. He told us to keep any money we use to pay bills etc in my husbands bank Acc, not our joint because the lawsuit is only against me personally and they could withdraw funds from our joint account but NOT my husbands personal account. We are in Ca - I always assumed that since we are in a community property state that it did not matter?
