Hello to all.
First, I want to thank everyone who posts on here. I have been perusing this site for about a month now and it has helped me tremendously with decisions and information. A little about myself.
I'm 31 years old. I work in media. It is a dying industry. There have been two lay-offs in the last two years and now mandatory two-week furloughs for everyone. Two weeks off without pay. Forced. No choice. They will probably start again in the first quarter of the new year.
I used CC's to offset the cost of living. I did the same with student loans. before I knew it I was in debt way over my head.
My tried to change spending habits, take in a roommate. I negotiated repayment terms with BOA, Citi and DC. All was going well. About last December through March of this year FIA card services (BOA) double billed me every month. I would wake up and have 18 dollars in my checking account on payday. i would call and get different answers from everyone I spoke to. One lady said I would have to wait 15 business days so BOA could make sure they had my money before they could refund it. One guy had it back to me in 2 days. Needless to say by the 3rd straight month of this I cancelled all arranged payments with them. After having "defaulted" on the internal program, FIA refused to let me set up another one internally. The calls began. They threatened me with the dreaded charge off. They let me know that as soon as it charged off the garnishments would start immediately. (I know this is not true. When i informed her that was false, she tried to make it sound like I didn't know what I was talking about)
So now here i am. I am currently going through the NOLO Chapter 7 book; looking at filing Pro Se in the Alabama.
In total, I have a little over 32,000 in credit card debt.
I owe 4,000 to a university for tuition that they had to pay back to Sallie mae
after I dropped the class. They had refunded me the tuition, i spent it, then Sallie mae called wanting her money back when i didn't make half way through the semester. Sucks for me.
i also owe $105,000 in federally backed student loans to Sallie mae.
i know the discharge won't wipe out the SL's or the 4 grand i owe the university, but hey, it's a start.
I am just ready to get on with my life and start paying off the loans that won't ever go away.
i still need my pre-filing credit counseling. I will probably file in mid-nov 09.
Wish me luck.
ALSO: I talked to CCCS of america for an hour and a half the other day trying to get set up on a payment play to pay back all of my creditors. The told me BK may be my best option and would not put me on a plan.
