Why would I need to plan on getting rid of our vehicles?

Ok. We talked to a Credit Counseling company last night. It was recommended by our DOE. After reviewing everything we're about $771 in a hole every month. It would be around $500 a month to pay our creditors. With everything else, we just can not pay that. The counselor saw that and told us that bankruptcy would be our only option unless we plan on making $1000 more a month. Which I don't see happening. He said we would need to file on our $21K CC debt and our camper and my car. We just can not afford to lose DH's truck but with his truck we would still have $250 +/- every month after everything. I feel really good about that.

Now, where do we start? Do we need to review any purchases that we've made with our cards and see if we'd get flagged for them? How do we find a good attorney? This sucks, but we're soooo ready to start over.

What I meant was unless your bankruptcy plan included getting rid of the vehicles because you are very upside down on them. You can keep them post-bk but I suggest not reaffirming the loans.

Bankruptcy is a fresh start. If you're discharged from bankruptcy keeping an asset like a truck that you owe a lot more on than it's worth you are not really starting fresh.

Your husband must have a truck. Must he have one you owe more than it's worth? Could you not buy the exact same truck for much less than you currently owe on it?

I don't know what your monthly payment on that truck is but I'm sure if you let it go and purchased a similar or older model your payment each month will be less.
Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

My worry is getting approved for a new loan after filing. DH uses his truck for his business and his truck is everything he wants. I completely understand where you're coming from though so it does make sense.

I also wanted to add that I really appreciate all of the help and advice that you've give me. Thank you.

Also, can we turn our car in? Do they have to tow it or something? DH is worried about them just coming and taking it. We'd rather turn it in. I'm really so unsure about all of this that I don't even know where to start or how to start.
