    So where is congress in protecting our rights?

    Business bk is a piece of cake.. but personal.. geesh. It can ruin your career, take your home, your car and kick you to the curb. Business should be able to afford much better protection IE attorney's and CPA's that a private person can. So, why are we being held to a higher standard? BK back before this new law I am being told was so much easier, and it was easier for a person to get back on their feet afterward too. Congress, we put you in office.. where the heck are you? If they don't change some laws this will only get much worse over the next 5 years.

      Don't know why you think Chapter 11's are a piece of cake. They are expensive and time consuming. THey are also reorganizations meaning,divisons and brands and other assets are sold or closed/abandoned. Look at what is about to happen to Saturn in the GM bk.
      I think the big problem in personal bk is, the individual states exemption levels. You keep an awful lot of stuff in a place like Tx. In Al. you can lose nearly everything.States with poor exemption levels need to raise them to something reasonable.

        Yes, we put them in, and now we need to remove them. Congress is a large part of the problem in our country today.

          They certainly are. Unfortunately people seem to forget about the three levels of government, forget that the president is one of three. As it stands, I do not believe any level of government is administering our country any more. Lobbyist and special interest groups are and they have their hands in our politician's pockets.

          Too many people seem to fall for the song and dance, for the charm or likability factor of their politicians. We need to ask what is this person's actual credentials. If I had this person's resume, would I hire them to be a senator if I personally was offering the position.

          Worst of all is voting along party lines. People who simply vote for someone because the candidate has an R or D next to their name.

            I can go to Wally World and choose between a hundred or so different brands, sizes, flavors, and styles of toothpaste. When I go into the voting booth, I have 2 choices at best.

            And sad to say, it really doesn't matter if you pull the R or D lever. They are both bought and paid for by the same people, serving the same masters.

              I'm not sure what type of laws you are proposing that you think will help you move through BK. People rarely lose their homes in BK. I doubt many careers are ruined via BK either.

              My advice is don't depend on the government for anything.
              Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

                I think I was really refering to the impact on one at a personal level. If you go BK and people find out you may not get that job you want and need, or people may look down on you. If you BK a business it does not touch you on a personal level unless you are a guarentor on it. The businesses who are the most upset with the BK are the financial world that we just bailed out to keep them from going BK. So, if they can handle their own books with the CPA's they have, what makes them think we should be able too? They can refuse us a job in their little financial world because we filed BK, but it effects them little since we all have to bail them out. That is what I am whinning about.. ha ha

                  I think your concerns on a personal level are based on unknown fears not fact. The stigma of BK is pretty much gone. No one will look down on you for filing BK in this economy.

                    I think until we stop the lobbyists and the controls and influence that they can put into play that Congress will continue to represent those that can help them in office.
                    Just the facts folks.
                    Unless you can form an influential group of some sort today, you have little representation as an individual. Don't kid yourselves.

                      I work in banking.. if I get laid off, if I have to move for my husband to get a job, my career is pretty much done.. So, I am saying this from a very true vision of my future. I work for the most conservative bank in the country, and on top of that I handle money, big time for the very wealthy in our area. So, yes, I would be out of a job. And, I have yet to talk to one person where I work that does not look down on a BK, and my family looks down on it too. So, that is where I am coming from. Big concerns considering that hubby and I are almost 60, and he can't buy a darn job as it is. His career is actually F&I in the car world, and that is not coming back soon. We may have to move since no one will hire him here and that would really put us on the edge. Couple that with his recent medical issues and I am very worried about what a BK can do to you. What if he gets sick again with COPD he can do that, and we then can not file a BK because we already did.. Geesh.. I am whinning.. sorry.
