    Filing and being current on mortgage

    Need Information about mortage late fees and being current!
    Hi... I tried to get a mortgage modification and was told that because of my severe debt load I do NOT qualify for a modification (CitiMortgage) either through the HAMP or through Citi. I was going to wait to file after I got my mortgage modified. Now I know that is not going to happen and I'm over 70 days late on my mortgage (was told NOT to make a payment when going through the process)and I have to become current in order to file for a chapter 7. I am planning on filing in either late December or early January (for the 6 month means testing) and plan to have it current by then but... my question is are you really considered current if you have any late fees that are remaining on the mortgage? I need to get my past taxes caught up (not included in the monthly mortgage payment) and wondered if those late fees will be a problem when I file? Currently I owe about $1070 in late fees. Was told I could go on a repayment plan but that would take 12 months the way the company had it figured out and they wouldn't let me see anything before I agreed to it. I told the mortgage company I would get caught up on my own. I was afraid to do this without seeing what I was actually agreeing to. Do you have to have all late fees caught up before you file or is just having all the normal payments caught up enough? Please reply!

    I wish I could give you some advise but I am new here. I am waiting fo a 2000 check this week to get mine current and file the week after that. WOOHOO!!!!
