    Is it ok to call your Trustee?

    Had my 341 meeting last Friday,it went smoothly,only thing trustee wanted to know was if I had names of former tenants who I had to evict from a rental property.I said I didn't know if I still had their names or not. He said if I did to give him their names because he could get the money they owed me. Turns out I no longer have the old rental contracts and no names or phone numbers for the tenants. The law firm I hired to represent me is horrible,doesn't return phone calls,emails and in general staff are rude.Only way I can get anything to move forward is by showing up at their office and waiting to speak to someone. It has taken four months to get this far due to attorney dragging their feet and blowing me off. They made several mistakes on my schedules and left off addresses to creditors as well as listed secured creditors twice and listing same secured creditor as unsecured as well. I paid for all costs up front and paid additional $150 for one of their legal assistants to help me fill out schedules which she entered into her laptop and two months went by before their bankruptcy paralegal got my case info. and she quit halfway thru so another month passed before new paralegal got my case.She was told to get me taken care of and they just seemed to want to get me out of there. I have sat in their lobby with several other clients who all were upset and had similar stories of this firm's ineptness. When they finally got my forms together and had me come in to sign them so they could file case with court,they rushed me through,sign these,take your copy home,look for any mistakes,if you see any let us know. I left the office and returned 15 minutes after because as I explained to the paralegal,you still have my files so going home to look at this will do me no good since I have nothing to compare to. I circled mistakes and she said she would make corrections and file case following day. I also asked when I would meet with attorney to consult about 341 meeting and was told 15 minutes prior to hearing. At 341 attorney didnot consult with me and trustee called my case,just glad no questions came up that I wanted to ask attorney about. So after all the delays and scrwe-ups by this firm I hesitate to call them and tell them I no longer have the above mentioned tenants names,thinking it would be best to speak directly to trustee. Yours thoughts on how to procede are apprieciated.

    Welcome to the wonderful world of horrible attorneys! My 'Hub and I have been just where you are.

    That said, even though the attorney/firm are next to worthless, you are still represented by them. Because of that, it may not be possible to talk to your trustee. The office staff will more than likely tell you to contact your attorney.

    But I will say to try it anyway. It won't hurt to try. Also, you might write a letter to your trustee and explain that you no longer have your tenants lists and paperwork.

    If you are disgusted enough with your attorney, you can file a motion with the court to 'Discharge Counsel and Proceed Pro Se'. We did this, but the judge didn't allow it because all the work had essentially been done and filed, and we were waiting for Discharge. This sounds like where you are at.

      Now that's interesting. I've got the names and ssn of everyone that has been evicted and owes me money. It would be really interesting to see the trustee get paid from these.

      That show would be worth buying a ticket for!

        If they were evicted, go to County Records and look up the eviction Judgment. It should have all info on it a partial SS numbers. 'Hub
