    Preparer Problems

    I hired a preparer to help me file Ch7 but he's made a lot of mistakes on my forms.

    I've asked him to make corrections to the obvious mistakes that I've pointed out and he tried (reluctantly) to fix them but I'm still finding mistakes. Mistakes that I pointed out to him and already asked him to fix!

    No doubt, this guy is not the sharpest knife in the drawer but neither am I when it comes to filing BK (having never done this). I just don't know if he's very good at doing this or simply doesn't care. I already paid him and I don't plan on paying him any more and I don't feel comfortable dealing with him at all.

    My questions:

    Can I simply make the corrections to my paperwork on my own?

    If my paperwork isn't done correctly won't this screw up my case?

    Is the preparer responsible for the correct data entry or am I?

    Note: If I had the means to hire an attorney I would have but I don't.

    Your signature on your paperwork indicates that it is accurate and true. You are responsible to make sure the information is correct.

    Sorry...but that is how I understand it. I see no reason you can't correct it yourself, as long as it is neat and presentable when you are done. No big RED correction marks, with black correct numbers written nearby...

      Exactly what NoMoreCards writes above. You are ultimately responsible.

      Yes. You can make changes on your own.

      Yes. Your paperwork issues "may" affect your case (for example: mis-coding an exemption).

      No. The preparer is not responsible for any incorrect date, you are, as you certify that all the things on the petition are true and correct under penalty of perjury. The Trustee, during your 341, will also ask you again if everything is correct and that you reviewed it!
