    Filed Pro Se but now think I need to retain attorney

    Hi All

    I just found this forum and frankly I wish i found it sooner. I took the means test, passed it and went and filed pro se under Chpt 7. I already have a 341 meeting date set. I'm wishing now that I hadn't jumped the gun.

    Someone pointed out to me that I will more than likely be pushed into Chpt 13 due to my high income.

    1) I'm totally open to converting my Chpt 7 to Chpt 13 but will ANY attorney touch me at this point? I'm ready to pay full legal fees for them to represent me so coming up with money for that is not the problem.

    2) What can I do NOW: Can I ask the court for an extension of any sort to amend the case and file correctly this time with attorney representation? Or is there a drawn out process to ask the trustee to dismiss the case?

    3) If my case gets dismissed under Chpt 7 because I didn't file correctly, how long before I can refile with the correct Chpt 13? How will this affect my credit?

    Thanks guys. It's been a roller coaster for the past week. I thought I was doing the right thing but now looking back may have filed out of fear.

    You can probably get someone to help you, but you better show up with money in hand. Attorneys don't like jumping in a case mid-stream, so money talks. Go and see a few attorneys for a free consult and go from there, or do a search on this forum for NY BK attys.

    You can convert to a 13 without much problem if you have to, you file a motion and an order, takes a couple of weeks and puts the 7 on hold. Forget about your credit at this point, you have larger issues to get past right now. Good luck.

      thank you whipster1. It comforts me a bit to know that it is somewhat fixable.

      I thank my lucky stars that I have a generous BF who said he would help financially to retain the attorney.

        Has there been a Motion to Dismiss filed in your case?

        In any event, the situation is salvagable.

          No there has not. I literally filed yesterday but am now thinking that I need to retain an attorney ASAP this upcoming week to make the necessary corrections etc.
