    Need advise

    I never thought we would be in this situation. Here is what happened to us:

    We were adopting my second son. He is a true biological son, to my first adoption. Cost were 8-10k higher than expected.

    Wife's work stop paying for her MBA - 10-18k there

    I was unemployed for 7 months


    Here are my questions:
    We are using our mother in law for day care. Will the courts consider the cost, or do we have to use a registered day care?
    Since we put 4k on a credit card recently (to finalize the adoption) how long should we pay on that one before filing bankruptcy?
    Should we stop paying the mortgage? What about the rental? What do we have to do with the tenant?
    Should we file chapter 7 or 13?
    Is it better to include the houses in the Bankruptcy? Or let them foreclose after the bankruptcy?

    Any advice in finding a good attorney in Ann Arbor/Detroit MI?

    You have a positive DMI of $245 per month. Looks like a Chapter 13 to me.
    Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

      So if I have to go chapter 13 I will have to make a small payment for 5 years? I really will not have much money to pay them.

        Hi Zorph,



        You will need to stop using the card that has the $4,000 adoption fee on it, and pay on it for several more months. Since it is a large cash-type transaction, you should wait six months to file. (longer is better)

        Payments to family members on your expense form is a red flag for the trustee.

        If you are intending to foreclose on your house, the sooner you save money to pay your attorney, live on cash, after you file, etc, the better.

        Right now your positive cash flow of over $200 a month would put you in a chap 13.
