The ONLY think you can do to "stop" the foreclosure is file a chapter 13 BK BEFORE THE SALE, short the bank stopping it (you can try to contact them and see how far you get). The real issue is what is the end game scenario and I think that that is what I and others are responding too. There does not seem to be an end game here. So, from a practical standpoint, you lost your house; UNLESS you propose a feasiable chapter 13 plan to pay back the mortgage arrears and can afford to start making your regular monthly mortgage payment. You are too far gone for a modification, and the modification you seem to want isn't really out there to get.
Now you mention Forensic doc audit, PLEASE, now you are just grasping. A Forensic Doc audit for what purpose.
I hate to say it, but is seems you made this bed, not your mortgage company. If the only issue with your mortgage was that it was negative (I assume you mean upside down), but you could otherwise afford it, you simply did not do your homework. Mortgage companies ARE NOT rewriting the principal balances.
It's not negativity you getting, you are getting the "real" story, you just don't want to accept it. If you really cared that much, you would have hired an attorney to help you and you would not be in this situation.Last edited by HHM; 08-17-2009, 10:50 AM.

1. You are, or have, committed fraud in a Federal Court system attempting a bk that you apparently do not need.

5. The money you held back could have been used to get legal advice and then you could have paid a person to tell you what about ten people here have told you, today.
6. This is reminiscent of a flim-flam, and it is you who have been fooled. When all else fails, follow directions. You did NOTHING right.
I have a very big heart for someone down and out. I personally have no feelings for the problems you have caused yourself as they were self induced with what I suggest was a bit of larceny in your heart. Now the day before "Judgment" you are asking the World for a miracle.
You love your house, that is apparent. You stated you could afford your house. You purchased your house for what it was worth to you at the time. It does not matter what numbers mean, a house is not a 401K it is a place to live in and hopefully becomes a home.
Your good news is, you reaped what you have sewn and will, hopefully, learn from it.If I knew it all, would I be here??
