    Hello, new to thread.....quest's please..

    My husband is wanting to file BK. We both work. But his income has drastically changed (construction bus.) I bring home approx. 740.mth.

    Do I have to file with him as well? Does my income come into play also? As for the median income, with only him and I with income (have son who lives with us, 13) do I have to list us as a three person household to determine the median income?

    I'm sure I will have more quest.'s

    Welcome to the Forum. Before anyone can venture an opinion, we need to know some more details. Are you using credit cards? How much in debt are you for the credit cards? Do you have a mortgage? Loan on a vehicle? Medical bills? Student loans? Divorce settlements/ child support, etc.? Having some information on those things will help.

    Whether your DH files seperately or you file with him depends greatly on your individual situation, and again, there isn't enough information to work with.

      I filed without my husband. (All the credit cards that had debt were only in my name) If many credit cards are in both of your names you will probably have to file together. They did include his income when figuring our the median income but then on my expense sheet my lawyer put down so much for husband's personal expenses. All three of you would be considered for family size.

        Welcome Sunflower. Yes figure your household as three. Yes your husband's income would have to be figured in. You may file alone if you wish, but as "ccfriend" stated, if most debt is on both of your names, you may be forced to file together. It also depends on the state and region you are in. 'Hub

          If you are not in debt though, it might be a good thing to have one member of the family with good credit. If you have co-signed on anything defaulted on, I believe the creditors can go after you, and also, if he goes BK you will be left holding the bag. Serious stuff. Those are definatly questions to write down and ask the lawyer when you go for your initial consultation.
