    Question Filed Ch 7, got temp job offer, now what?

    So I just filed my bk the other day and now I have a job offer. Should I just turn it down? It is a contract position for 3 months, so it won't have any long term effect on my being able to pay off my creditors. So if I wasn't able to file chapter 7 if I take the job, I'd be right back where I am now in 3 months.

    If I were to do the unscrupulous thing and take the job and not tell anyone what would happen? I'm not sure if it is W2 or 1099 yet as it is going through a staffing company.

    My girl friend said I should take it and just keep quiet, but I don't want to get in trouble, and she is a lawyer heh. I think it is lame that I should probably just be a lazy bum until the bk is completed instead of taking work and messing up the bk. The other thing is the job pays good money so it's hard to turn it down. If I did a 1099 and didn't have any income show up until next tax filing would that be safe?

    Take the job.
    It'll have no affect on your bk. The filing date is a snapshot of your financial situation.
    Just let your lawyer know. Sometimes a trustee will ask if anything ha changed since the filing. Tell them about the temp gig. A 3 month position won't change your longterm prospects.

      What about the money I would make? Won't they just take it all and assign it to the creditors?

        how much money are we talking about? A couple thousand a month? ten thousand? Makes a difference...

            About 11,000 a month yes. Only for 3 months though. Too bad I didn't make that much at my last job, I wouldn't be in this mess.

              okay. so the 11k a month for 3 months you will have two issues: 1. Will that put you over the median income for your state for the 6 months before filing?

              2. Can you cover any extra in exemptions?

              You won't want 20k sitting in your checking when you file- unless you have a 20k exemption (and no other assets to worry about).

              In CA for instance; if you don't own a home there is an unused homestead which allows a little over 20k to be exempted.

              If you can't exempt the money you'll need to check your states statues on wages. CA's is 75% of wages 30 days before filing.

                Well I've already filed, so this money would be coming after the filing date. Does that matter? I worked 3 months from Jan - March and earned about 18k this year.

                So I could potentially keep 20k if I had no house? I own a home with no equity, it is in Arizona, I live in CA. Was an investment gone bad.

                  No sense in working for free, am I right? Esp. if it's temporary.

                    congrats on getting the job.
                    Perhaps the hiring agent can put off paying you to the 6 mo. and 1 day mark ?
