    Question Checking overdrafts in Ch 7

    I'm new to this forum, and this may be out there already, but I thought I'd take it as an opportunity to introduce myself.

    My wife and I are almost certianly going to file chapter 7 (We're meeting an attorney later this week, if we like him we'll start to move forward). We have a checking account with BofA which we had basically stopped using about two months ago (we've switched to a local bank). Unfortunatly, I forgot to change a few of my automatic payments (totaling about $50 all together) and am now -$240ish. Does that make them a debtor now (actually, they already are, but on a seperate CC account, which is why the new checking).

    Yes you would list them separately for the credit card and for the overdrawn checking. They would be a debtor in both cases and both are dischargeable.
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.
