    More financial issues coming -- need to time the filing

    Surprising communication has been quiet from creditors. I stopped paying chase & AMEX and have heard nothing from the collection companies that AMEX referred the debt to and Chase may or may not be calling a disconnected phone.

    Looming issues that may ultimately may give me no choice but to file
    I hastily skipped out a lease in Stamford CT in May. Have not paid rent since then on that place but have not gotten any court notice or anything. I found another job here outside Boston (where I truly REGRET moving to) after being unemployed for close to 6 months. My new rent is $1,732 with utilities plus another $178 a month for Verizon FIOS, old apt was over $2,000 a month at least 1/3 of that building was vacant and couldn't find someone to take lease by time I had to start my new job. I made a few trips from Stamford CT during the weekends over the last 2 months to retrieve my things.

    When the notice to quit comes, I will answer it by saying I moved and mailing back the keys so at least they won't need to goto court to evict me out of the apt.

    Next, a few gym memberships that I signed up for EFT contracts then decided before the next months billing I didn't want to continue. I just cut the credit card and reported it lost to the credit card co's and I am getting dunning letters. One is for close to $2,000 in unpaid EFT and another will be $128 * 12 whatever that is.

    The filing may have to be done at the right time so the automatic stay applies. If I file now and later landlord gets the judgement then the stay may not apply right??

    Of you broke a lease contract with XYZ Company for $$$$.$$, you will list the company as a Creditor and an approximate amount. The Company will receive notification from the Court in regard to your Bankruptcy.

    XYZ Company is given 60 days to dispute the amount owed in a Creditor's Meeting at the Courthouse where you filed. I really doubt that a lease company or individual will drive thta far to contest your bankruptcy. Once you receive your Bankruptcy discharge from the Courts & your case is closed, you don't owe xyz company nothing.

    The automatic stay is the time you file BK up until around 60 days to receive a discharge. Now that's the way the law reads; however, more & more people are filing BK and courts are getting backlogged, so 60 days is usually not the norm, Now, in which you receive your discharge and then closing of your case should follow. During automatic stay no Creditor, by law, is allowed to contact you, either in writing, phone or in person.

      You may not get any notification from the landlord. On the lease that I use, you sign off stating that if water or power is not connected to the property, then I may consider the property to be abandoned. This means that I don't have to find you or evict you. Then, if you bankrupt, but don't list me as a creditor, then I wait until you're out of bankruptcy and go after you for the debt.

      The statute of limitations goes "on hold" while you're under bk, so while in GA, there is a 4 year stat on this, the collection agency that I use will just wait until you're finished with bk and then go after you.

      You need to get this finalized with your former landlord or this one may bite you. Mail them the keys with your new address and request for them to send you a bill with all charges due. Then....... add it to your bk.
