    can you be denied??

    this may seem like a dumb question to all the regulars, but im new to this. im basically wondering if you can be denied bankruptcy. im sure the answer is yes in cases where bk fraud has clearly been committed, but like in my situation for example, more then 10 grand in credit card debt, got laid off from job, have another kid on the way, my unemployment is the only income for our entire family, and i simply can not and will not be able to pay off the debt, would they deny me from wanting to start over??

    and if they do deny people, what are some other reasons (besides obvious bk fraud, and it being too soon to file again) that one might get denied??

    You can be denied a Chapter 7 discharge if, you have enough disposbale income to fund a 13.
    You can be denied a discharge if you don't have the CCCS certficate prior to filing or, the debt management course required prior to discharge or, your petition is incomplete or inaccurate.

      For 10K in debt, you may just want to turn off the phone ringer for a while. The absolute worst that could happen is that they get a judgment and try to get at your bank accounts.

      The card companies are actually willing to settle more often now it seems, since the BK cases are spiking...so a few months after stopping payment to them look for settlement offers in the mail.
