    Moving Prior to Filing BK

    Help. Our business failed in April 2009, and due to personal guarantees with vendors and a small business loan, we are forced to file personal bankruptcy. While doing research we realized we would be a Chapter 13 based on means test with current income from wife's current contract job. A week ago she received an offer of a permanent full-time government job for less money, and we must move 120 miles to the new job. The new income would put us in Chapter 7 based means test.

    Question: How do we stall vendors (suit filed 10 days ago), and bill collections to get the higher income removed from the means test? And, it looks by our numbers we would possibly qualify for Chapter 7 anyway based on disposable income with the new job and location if our college loans are included in budget. Any suggestions?

    If not, the lookback period is 6 full months of income.

    Many of the posters here waited longer than that to file. To delay your suit, just answer it. You may want to consider having an attorney answer for you - or if you do not have the funds, answer yourself. This in itself will delay the suit long enough for you to file with your reduced income.
