    wage garnshment

    If I am in the process of filing but I have not went befor a judge or any thing nor have I finished paying off my lawyer befor we file is it legal for a creditor to do a wage garnishment

    You have no protection via the automatic stay until, your bk is filed.

      Is the creditor threatening wage garnishment or do they have the judgement already that they are now seeking garnishment from you through your employer?

      If they are just threatening garnishment, make sure the creditor is listed on your petition.

      If they already have the judgement they can garnish your wages right up until the time you actually file BK. Once you file, then the automatic stay will stop the garnishment. Make sure your attorney has the judgement and garnishment information.

        No they just started yesterday and thanks for the advice
