    Filing Tomorrow & Bank $

    If we file tomorrow... will that protect my husband's paycheck that goes in the bank following filing day?

    We are filing tomorrow (hopefully). Lawyer has everything she needs, she said, and said to just give her the word. I asked to do it before my husband's paycheck so that way the funds are low. I asked her about the timing as it will be Thursday when we file and he gets paid Friday. I haven't received an answer yet, but I'm antsy and can't wait..... which is why I am asking you all. Wish us luck. (crossing fingers and toes).

    I had one of those moments where everything is in slow motion... we signed the papers and walked out to the car to take them to the lawyer... it was literally like a movie where everything goes super slow. Felt very surreal to me. We've been married ten years and never imagined that we would be in this spot... but strangely, it has been such a relief on our marriage. finally able to breathe (somewhat... of course when everything is behind us... breathing will be easier). We don't have to worry about what the other is spending on credit cards anymore because we don't have any (which we've been living like for 6 months now). We now have to have the money before we buy and it is such a relief. Knowing that we have to buy only within our means.... I can't believe that I would be relieved to have bad credit. odd thing, isn't it?

    Disregard... paycheck went in a day early... go figure. I guess work wanted to be nice and give it early for the Holiday weekend. I guess that they just made my decision a bit earlier.

      It does not matter.
      If you are filing this month they are only looking at income you got from 1 Jan through 30 June. That's the 6 month period they are looking at.

        Yes It does matter how much is in your checking account on the day you file.

        The Bankruptcy Court is not very friendly about this issue. It doesn't matter if you have outstanding checks/and or deposits. The day you file Bankruptcy is a Snapshot of your Checking Account.

        Our BK Attorney told us to make sure we had less than $100 in the account that day. He said if you have bills at the end of the month due, take the money out a week before date of filing and go to cash receipts.

        To OP hope your Attorney did not file the date your Dh's check was direct deposited.
