    2 year living in a state

    I moved to another state a year and 9 months ago when i started my job. But I bought my house excatly two years ago. When I file BK how do they determine that I have been in the state for two years? BY house or by job. I just need to know when I can file for BK in my current state instead of my previous state.

    Are you trying to use your new states exemptions? If your new state allows you to use the federal ones and that is what you want then you only need wait 91 days. If you are looking to use the ones from your new state then it needs to be the full two years.

    They go by how long you actually lived there, you sign your petition saying how long you have lived in the state. If you have owned your house in state for 2 years no one would probably notice, but I would go by the real date you moved in.
