    Why say laid off?? I worked as a CNA taking care of a quad. The company I worked for took me off the case of caring for him, because of things the pt was doing and they didn't have any other work for me...so in the end I resigned. For lack of work. Can I just say lost job then??

      If they ask at the 341 if the papers are correct...should I say yes....or yes...but I lost my job???? I appreciate that you have been kind to me for helping me on here. I hope you are not sick of my Cr*p..... I told you already I didn't get my ct date paper......could that mean something is wrong????? Or they are just running late???? Or what????? It tells on there pesumption of abuse or not right???? I have a simple BK 7 and no money...I hope it not that or something....

        The words shouldn't matter as you don't have a job. I wasn't making any distinction at all.

        Ask your attorney how you should answer. Most will say to say yes the papers are accurate, but you lost your job since filing.

        Means nothing. Perhaps all papers are diverted to your attorney anyhow. Again, just listen to your attorney. If he says to show up on 7/20/2009, then that's the date. It doesn't matter about you not getting the paper(s). It's only important that your attorney is served paper(s).

        No, the papers just says what the date was for your 341 Meeting... and usually contains an "info" sheet that states what they need in advance. It's usually standard. If the Trustee has any problems with your case, they contact your lawyer.

            You are represented. When a person is represented, they must contact the attorney. So, if they need anything, your attorney or his paralegal will contact you. Just relax... because they usually don't need anything else in 95% of the cases. I don't think you fit the small 1 in 20 that need additional paperwork.

                What about this.....if my Lawyer says my alimony is exempt and my retirment is.Meaning they can't touch it right? I have been drawing it out everytime it is deposited....are they the tt going to ask where it is going? Like what am I doing with it when I draw it out? Will they ask me for reciepts and stuff? I use it for everyday living expenses....still pay HOA,electric, food, gas...spend on my son. I get like 1747.00 a month...not working right now.Please answer...justbroke...thank you.....mind is racing again.Sorry.......

                  If it's living expenses, don't worry at all. With no job, they could wonder where it goes, but it will be quite obvious. No worries. No one knows what questions will even be asked. I'm thinking that you won't be asked anything but the standard questions.

                  They may ask, but you say exactly what you say here. If they ask for receipts, you just say you have none. Trust me, the Trustee knows what "reasonable" expenses are for every category of expense. They do this for a living.

                  You are not a person who makes over $100K a year and discharging over $100K. Those are the people that they are looking at for "abuse" of the system. They are not looking to bother a divorced mom who doesn't have a job.

                    Do you mean 100k in just cc. Or total amount? I don't have that is cc.....not even close. Anyway, cuz my Lawyer told me to quit paying the bills if you are going BK on them.So I did.I have to pay the HOA and Electric on the condo. I mean.....will they want to know if I have money left to pay any other bills. I just don't get it?? I don't understand this part?? I mean could they want all this stuff before the hearing date??? I'm overwhelmed at times with all this stuff.I'm confused....as to how it all works.

                      No, they won't be asking if you can pay other bills. They look at your Schedule I and Schedule J to determine "what" money, if any, you have left over.

                        According to that there is none. I also had a job to at the time...but not making much.2400.00 monthly income when filed, now 1747.00 in CO...huh....

                          I just noticed on the income papers filed my alimony says 1200.00 suppose to be 1300.00 and my retirement went up about 22.00 dollars.As of May 1st. OMGOSH are these errors to worry about. If they ask me if it is true....what do I say??????

                            Check all your paperwork again. Talk to your lawyer. If there are errors, your lawyer will either correct them before the 341 Meeting, or make a statement during the 341 Meeting that they are incorrect and that you'll amend the schedules. If your attorney took all your numbers from the papers.. then they should be accurate. If not, talk to your lawyer. Transcription errors happen all the time. From what you write, yours don't amount to much.

                                My Lawyer may call me today or I may have to have an appt. I gave him the numbers cuz I thought I got 1200.00...but according to my settlement papers which I dug out for my audit, it says 1300.00. So that would make everything off.The papers are already been filed with the court now. I wonder what my Lawyer will say and if he will have to fix all this and charge me a lot to do it. Here I go again....stressing. I don't want to have the hearing come and what would you say if they ask if they are right (the papers) ?????
