    Question Can I file?

    I am from Massachusetts. I am disabled and get $1,599 from Social Security. After I am done I hav roughly $500 left a month.

    OKAY the big problem is I already have one judgment against me for a debt that is mine. I am now in court for a debt that is not mine and the debt collector is having a tough time proving it. They sued me once and it got dismissed without prejudice. Then a different atorney purchased the law firm and he sued me. It has been going on almost 2 years and with the corrupt courts in my state I know I am going to lose.


    Seeing as I denied the debt all this time, does that stop me from Filing? I was told that it would be perjury be including this lawsuit in bankruptcy because it is admiting to the debt by doing that.

    Any help would be appreciated.

    No biggie. Your lawyer will schedule the debt and note it as disputed.
    It's dischargeable.

      oh okay so disputed debts can be included too. thanks a bunch. I go to trial in September so I should be able to get an automatic stay before that and stop this case from proceeding,right>

        The automatic stay is in affect the moment you file bk. It halts all collection activity-even lawsuits.
