    Filing and the impact on current delinquencies etc..

    If I file and if discharged, what happens to delinquencies & late pays on credit report. Do they just say included in BK?? what happens to the current debt amount outstanding.

    So far I have 4 delinquencies and this is just the beginning. I also have to deal with the lease I skipped out on with 10 months remaining. I mailed back the keys to the landlord with a note that I have given up possession of the apartment and moved out of state due to unemployment.

    One thing that I noticed is that having bad credit these days seems worse than ever. Even with enough to put upfront, I was denied for over 10 apartments here near the Boston area despite making much more than '3 times the monthly rent', needed to cancel renters insurance after I mailed policy confirm to the leasing office because the rate was $100 more than quote because of bad credit, cannot even get a cell phone contract from any provider with any amount of deposit, the best car loan I can get is to put down $12,000 on a $15,000 vehicle and finance the remainder at 21% etc..

    Somethings I have been told is that the amount of debt + utiltization + accounts in collection is a deal breaker for any entity that uses a scoring or model to accept or deny like apartment complexes that wouldn't even accept additional deposit or more months rent upfront, and things like cell phone service.

    My situation was bad for a long time and then became immeasurably worse when I lost my job last November. I stopped paying several credit cards and basically walked from other bills like cable, electric at old place & then the coming issue with my previous landlord.

    another question is will a filing be able to block at least temporarily any civil judgements at least for the months of rent that I may be liable for?

      The short answer w/o doing any other research at this point, is YES. Filing BK will kick in the Automatic Stay which will stop-dead-in-its-tracks any pending or ongoing lawsuit or judgment. Any judgment you may already have against you will be negated.

      Now, having said all of that, there are debts that cannot and will not be discharged. These include Court-Order payments, such as alimony and child support; restituion for Criminal charges; most School loans--some can be pled down as 'hardship'--but you will be 'hard-pressed' (pun intended) to prove the 'hardship'. There are others, but those are the biggies.
