    Consult with Attorney Friday, too many variations..can you help?

    DH lost job. Has prospective job offer potentially coming very soon (all signs point that way). We made above median income so we were about file a 13, then DH was laid off. I lost my job because of funding cuts where I work. I did not get severance. We have an apt. with our attorney about what to do and I want to make sure I have all my "ducks in a row" before meeting so we don't incur another huge $$ charge.
    scenario #1
    get new job, use severance to settle cc debt
    scenario #2
    file 7 if don't get new job or new job is lower than the "median" income and we pass the means test
    scenario #3
    file 13 as planned and "pad" our budget (assuming we are getting a higher income at new job).

    We have decided in all scenarios to do a short sale on our house or walk away from it as our payments are more than 40$ of our monthly take home.

    I'm sorry to hear about your situation. By all means, talk to your attorney about your situation. I think a Chapter 13 could be a risky thing to try at this time. Do you have to file right away? It might be better to wait and qualify for the Chapter 7. A Chapter 13, even with a padded budget, could be really tough with such a significant drop in income. You can always switch from a 13 to a 7, but imho it's easier to just wait and file the 7.

    Also, after my own personal disaster with attempting debt settlement, I would NEVER recommend anyone to do it. Do a search on this forum for debt settlement and find out more before you decide to go that route.

    Again, your attorney should be able to help you. It always helps to see him informed though. Best of luck to you. Let us know how this turns out.
