Wow... if only the courts thought like you do! Yes you are "only" 20...so why does "only" a 20 year old have so much debt? You think its a piece of cake to just say "hey I will declare bankruptcy and all is right with the world?" Don't think so. From what you have said, there could be a learning curve here since we are not part of your life, but based on that it is not "legit".

And ... you should have known what you were getting into ...but hey I got married at 20 to a complete idiot/abuser, I shoulda known better but hey I did it anyways... we all do crazy things when we're young.

Trick is with a bankruptcy you need income...from paychecks... and tax records based on real income with real tax documents. You cannot "hide money" or "lie".

I know this stuff isn't what you wanna hear...specially from crazy strangers on the internet... but someone needs to tell you cause its obvious no one has.

If you do find a crazy attorney that will do it for you, then I wish you very very good luck. I know what its like to be in situations you can't see your way out of. But honestly, as you mentioned, you are young... suck it up... don't go partying with your friends and pay the debt off... eventually you will earn more money etc..then by the time you're not "only 20" ... you will be able to live your life.

^ I really appreciate all your advice. Forums are a great place for advice..and tbh with you strangers give unbiased advice unlike who I talk to (who will obviously bias their advice for me).

I am somewhat mature. I will admit I am stupid, I made stupid mistakes. I just want to sculpt whats best for my life. As it is this debt has definitally hindered my social life. That's fine..I'm living with it. Plus I need a money-saavy girl anyways..not one that doesnt care if im broke..

If I had made this mistake previously I wouldn't have just made it over the past year.

Please Do! I will be thinking about you for the next week and would like to see a Post from you either Fri. or Sat.

I was married right after I graduated from high school. 1 yr. & 5 weeks later, I gave birth to my son. Went on & graduated from college with an Accounting Degree.

So I kinna know how you are feeling. And Hey, you've stated these are Your Mistakes. Got a lot of ideas for you after Consultation with Attorney.

O, take your last year's tax return with you. Take a Nice Handwritten or if you have any Word software, list your Gross Income for this year & Expenses less the expenses you want to Bankrupt. Those possible Bankrupt Expenses list them in a column by theirself.

I don't agree with the Underlined word. I do Agree with trying to find the right path. Honestly, I'm praying it's not Bankruptcy for your sake. But, we will let a BK Attorney decide that

Anything you can think of concerning your Finances, put it down to take with you to Consultation. Take backup for Income (whatever that maybe). Take your last two Bank Statements with you. Go in there PREPARED

              And again, Good Luck!

All I'm trying to say is that if you hide money, falsify documents or lie. And, get caught. The Judge is going to give you more than stern talking to.

Please, for your own sake, don't do any of these things.

To the OP - Get a few consultations with some BK attorneys and take your dad along with you - I think it will be an eye opener for him also that he is enabling you to get in the trouble you are currently in. If you don't straighten this out now, you will be back posting in this or another BK forum in several years or less - if you file Chapter 7 now, you cannot file Chapter 7 again for another 8 years.

Ok I went to my first consultation. I plan on seeking 2 other lawyers advice.

We talked for about an hour and he went over everything. In his opinion, I have a very strong chapter 7 case, and that he recommends the BK. His main rapport for filing is that I owe $27,000 on a vehicle worth $13,000 (maaaybe), he said go ahead and dump it.

Basically he said I just need to show him my 12-month wells fargo statement, 7 months worth of pay stubs (copies of the checks my dad wrote me - already discussed the paying under the table thing with him), and verified that I made less then $22k in the last 6 months and that I hadn't charged any credit in the last 90 days (its been close to a year since ive charged anything), and that I've been trying to make my payments (which I have).

He said it's a good idea, so I'm going go ahead and consult 2 more lawyers and go from there. What do you guys think?

Any idea why he said not to have charged anything for 90 days? I will most likely be using the credit card until the day I file...

My attorney said that using it for small things like groceries, gas, and small living expenses is probably ok. Living on your credit cards is what got you into the mess in the first place. If you have already made up your mind to file, you should stop using them though.

I also have recent charges on some of my cards but nothing large or luxury.

So glad you posted. Would agree you need to other consults.
I'm intrigued with '7 months worth of pay stubs'. That's a new number I don't recall in my research. You discussed the paying under the table with the Attorney? Sure he doesn't care. You provide proof, Attorney is happy.

Dad is the one who will have to calculate your Gross Income less specific taxes to derive at your Net Income and specific dates. Brings up more research LOL!

I agree with Flamingo. Take your dad with you, if you are able to do so to at Least 1 preferably Both.

If I quit charging, then I have to quit paying. I am stuck in the cycle of having to charge bills to afford to make my minimum payments. My lawyer said not to stop paying yet, since we do not know when I will be able to file...

Soon the credit limits will be gone...then...
