    im so screwed

    got unemployment after i lost my job. employer files appeal, judge agrees with them, have to pay back unemployment.

    i have no job, had to move back in with my parents, have no money, can't afford the monthly payments so im pretty much screwed.

    what i want to know is if i can get rid of this unemployment repayment through a bankruptcy, state of minnesota by the way.

    sometimes i wonder why life is worth even living when everyone is out to screw you.

    How much is it? How old are the payments? How old is the order to pay it back?

    Under what circumstances was it appealed?

    Can you appeal the decision?

    I don't know specifics for benefit repayments, but with other government debts the age as well as the circumstances that caused the debt affect if it can be discharged.

      he disagreed why i left. i stated because it was a hostile enviornment, the employer said i left my own accord.

      i can appeal it, but dont think its worth bothering. have no other evidence i could present and i know the judge wont rule in my favor.

      the amount is 5,400. they want 150 month over 36 months.

      like i said though. no job, no money, impossible to pay, so itll just accumulate with interest over time.

      theyll send it to a collection agency, levy my bank account and garnish wages if i dont pay, but theres nothing they can take because i have nothing for them to take to begin with.

      if i could get this in a bankruptcy though, ill have other debts that i could throw in now since i wont be paying those either.

      no payments yet, they want the first one by the 20th. i just lost my appeal the other day so like i said the first payment they want is 150 by july 20.

        Appeal, if it doesn't cost anything to do it, you have nothing to lose and everything to gain

        Do a bunch of research before you appeal, especially hostile work environment issues and know your stuff when you go in.

        Any ex disgruntled workers you can find that will back you?

          Extremely good advice. What exactly was the reason in detail? Could it have been sexual harassment? WHAALAA. Then a suit back. (ONLY IF TRUE).

          If peer persecution, that is valid. You obviously are on the Internet. You are not employed. Your full time job now is research.

          PLEASE do NOT accumulate purposeful debt with the idea of bk. That could lead to some serious problems.

          Cheer up, there are far worse problems to other people. You have your parent/s and a place. Bk is for a fresh start. If you study every "sticky note" on this site as well as Google Bk law or get the Chapter 7 book from Nolo press, nolo.com for about $17 bucks you could even go pro se. You can get a pass on the fees for filing if you fill out an indigence form.

            You need to know if Minnesota is a 'Right to Work State'. If it is, you may in fact be hosed. If you left your job of your own choice--no matter what the reason--you will not get unemployment. I left a job in 2004 for exactly what you said--a hostile work environment--and I was denied benefits.

            In 1992, my full-time job with a high school ended when my hours were cut in half, and I was expected to work for the then minimum wage w/o benefits. At that time I was driving a 60 mile round trip per day. I had a car payment to make, not counting oil and gasoline, never mind any other bills I had. I left. I applied for Unemployment.

            The school appealed and tried to say I left of 'my own free will'. At that time, 1992, the Examiner looked at all of the paperwork and situation and ruled: "You did not leave your job. Your job left YOU!" I got and kept my benefits.

            That said, that was 1992, this is now 2009 and who knows what is going to happen.......

              What sort of workplace hostility occurred that caused you to leave the job with such haste? Consult an attorney (usually free first visit) who specializes in employment law. Who knows, ne may actually take your case on contingency under your circumstances, and if your case is winnable.

              So, what happens if you can't and don't make the first payment? They may rant and rave and threaten...but the "turnip (you) has no blood." Frankly, the unemployment insurance company trying to collect a small debt might not be worth their trouble.

              But cheer up. While this may seem an insurmountable problem at your young age, it is really not so bad an issue. You have learned a valuable lesson about employment, and that is to plan ahead before taking drastic measures in the future. Plan ahead, anticipate consequences BEFORE you take action. Good advice for any of life's circumstances...always be prepared for the unexpected. You will manage to work through this, seek advice and help, and do not try to muddle through without support and help.
