Another reaffirming Question

Hi hi, I have so many questions!

I am getting married this Saturday... yea I know terrible timing. Its a civil service that I've spent maybe 400 on... anyhoooo.... we purchased rings on my kay jewelers card in April. I had no idea I was going to end up filing until the beginning of this week actually.

I mentioned this to my lawyer and he said no problem can keep rings and I told him I felt really bad about charging it last month and then doing a bankruptcy. I told him I wanted to pay it back and he said no problem we can reaffirm it.

I imagine they would feel the same way if I tried to write it off right? I would think they would make an objection if I tried to throw it in with the rest of it. Its only like 2,700 dollars but its like 140 dollars a month.

Should I just upfront say I will reaffirm it or wait to see if they make a fuss about it? I dunno if its greedy of me to hope if it can be put in but I am trying to do the right things in all this.

I have already made 1 payment on it as well.

Hmmmmm.....you joined the BKforum in March.....purchased rings on a credit card in April...........but had "no idea" you would be filing???

No I did not... just because I register on a forum does not mean I meant to do anything. And I do not need to justify myself to you.

And I also said I wanted to reaffirm the debt for the rings... I was just wondering if it would cause a fuss if I waited to see if they would question it. Was just curious.

Instead of reaffirming, maybe try to redeem it for a lower amount? We had a similar situation with a tv from Best Buy. Bought in December when dh was gainfully employed and only paid a $25 each month on it through March when he lost his job. We ended up in BK only a month or so after the job loss and I had only paid less than $100 of a $1000 tv that we basically had just purchased. That's the only purchase we felt totally guilty over because we haven't been using the cards except for rare occassions for the better part of a year and a half. Anyway, I told the atty that we felt guilty and he said if we really wanted to throw some cash at Best Buy, we could redeem instead of reaffirm. He said we could offer them $500 and we agreed. Sometimes I feel foolish for redeeming it when I know they probably aren't going to come after my tv anyway, but I sleep better at night for it now. When that redeeming happens, I'm still a bit unsure. Our 341 is tomorrow and we still haven't done anything with it. I'd ask the atty about redemption instead of reaffirmation. Should save you a few bucks.

Thank you! That does sound a lot like our situation... I hadn't used the card in a while and it had a zero balance on it before we got the rings. I feel totally guilty about it especially since wedding rings and stuff are exemptions in VA. That does sound like a better solution. How quickly do you have come up with the money when you do that?

Good luck at your meeting! I'm interested to know how it goes. This whole process scares the bejesus out of me.

A word of advice here.

You will be questioned on everything that you ask advice on. Don't take anything personally. Relief just voiced what most of us probably wondered.

I havce gotten hammered a few times and you know what? it made me think twice about a couple of steps I was looking into taking.

Ask lots of questions and you may save yourself allot of heartache.

You might just have registered on the forum for information but just the same registering for a BK forum without any interest in BK IS a bit hard to justify.

Hey, nobody is here to judge you unless you demostrate an attempt to defraud the system and you are FAR away from that so just ask questions but be prepared for good answers and hard questions.

I think downsized brought up a good solution to your problem, ask to redeem instead of reaffirming! Even if you paid a couple of payments, you don't want the creditor objecting to the charge and holding up your bk, costing you more $$.

My 341 is TODAY. I thought I'd be a nervous wreck, but I'm actually sorta anxious in an excited sort of way. I'm happy we're going to be one more step there. Anyway, the lawyer asked if we could come up with $500 and I said yes. I assume if, when you get the point of negotiation with the creditor, you say you're willing to pay $X.xx, you'd better be able to give it to them almost on the spot. I'll keep ya posted on how it works with us.
